These terms govern your use of this website and its content. By browsing the site you signify that you agree to be bound by these terms.

Proper use. This website is protected by copyright which extends to the design, content, images and graphics, image categorisation system, and programming code. You acknowledge that you may not copy, reproduce, distribute or publish any of the material on this site except as indicated below. You further acknowledge that you may not, except as authorised, seek access to or make use of information and files held on this website that are not available for public browsing; nor may you tamper with this site or impede its proper functioning.

Use of images. Copyright to each image on this site is held by the contributing photographer. You may view these images on your computer and you can incorporate them in pre-publication trial layouts, but you may not otherwise use, copy, reproduce, distribute, or publish these images (including thumbnails) unless you have obtained a licence to do so. If we do not receive the fee charged for such a licence, the licence will become invalid without any further notification on our part and any use you make of the image in question will be without authorisation.

When you procure a licence to use an image from this site, your use of that image shall be limited to the permitted use specified in the licence. You undertake to make no use of the image that exceeds the permitted use. Images are made available to the individual or entity specified in the licence and neither the image nor the licence may be transferred to third parties unless this is expressly permitted in the licence.

No affiliation with third parties. The display of images on Touch The Skies does not imply any affiliation or relationship between this site and any individuals or entities featured in such images. The same applies to the display of selected images on our homepage: these are picked on the basis of artistic merit, relevance to specific themes, or newsworthiness.

Third-party authorisation of image use. Images featuring recognisable individuals, company trade marks or logos, or objects whose ownership is identifiable (including but not limited to aircraft with visible titles or registrations) are made available for editorial use. We will licence other uses on the understanding that these uses may require additional authorisations by parties other than ourselves. You acknowledge that it is your responsibility to ascertain whether or not you need any such third-party authorisation, and to obtain it if it is necessary; that such authorisations are not part of the licence provided by Touch The Skies; and that Touch The Skies has no liability if you fail to obtain such an authorisation.

Liability. We make every effort to ensure that the information in Touch The Skies, including the data presented with each image, is accurate. If you publish incorrect information pertaining to an aircraft type, sub-type, operator or operator representativeness as a result of incorrect data presented with an image for which you have bought a licence, we will refund you the fee you paid for that licence. For this purpose "aircraft type", "sub-type" and "operator representativeness" should be understood as explained in the "about our photos" section of this site.

We will also refund you the licence fee if you find that the quality of the full-size image is not up to your requirements, provided that you tell us what the shortcomings are within ten working days of receiving the image.

Other than this we can accept no liability arising from your use of our site and images, and you acknowledge that no such liability will apply to us. Furthermore, you indemnify Touch The Skies from any liability or damages arising if you use this site improperly or if you fail to abide by these terms of use.

Privacy. The information you supply to Touch The Skies will only be used to provide you with the service you have requested and to get in touch with you should this be necessary for site administration purposes. We will not pass such information on to third parties or use it for direct marketing. However, we may from time to time advertise our services using publicly available contact information (including e-mail addresses), so you may receive marketing messages from us if your contact details are publicly accessible.

Some functions in this website involve the use of cookies (small electronic files which are stored in your computer's hard disk and retrieved by this website when you access it again). These cookies are used to record preferences such as the number of images to display in each search results page. They are not accessed by websites other than Touch The Skies, and do not record what sites you visit before or after browsing Touch The Skies.

Site ownership and legal jurisdiction. Touch The Skies is owned and administered by Charles Polidano in Malta, a member state of the European Union, and is subject to Maltese law. You agree that any legal claims or actions relating to Touch The Skies shall be settled under Maltese law.

Changes to these terms. We may alter these terms at any time. We will seek to notify registered users if the changes are likely to affect them materially; but the changes shall have effect regardless of whether such notification takes place, except as may be indicated in the terms themselves. If, however, you have a claim or complaint in relation to these terms, it will be addressed under the terms in force at the time you bring it to our notice and it will not be affected by subsequent changes to these terms.

Meaning of terms. In these terms of use the words "Touch The Skies", "we", "this website" and derivative expressions are synonymous.
